EPA Fines Company for Untested Pesticide Claims

Kinetic Solutions Inc., Monterey Park, California, has been fined $82,400 by the U.S. Environmental Protection Agency (EPA) for allegedly selling unregistered and misbranded pesticides and making unproven claims about their effectiveness.

The EPA alleged that Kinetic Solutions, doing business as Rabbit Air, violated the Federal Insecticide, Fungicide, and Rodenticide Act by making illegal public health claims that its air purifier “Nano Silver Pre-Filter” had the ability to control over 650 types of bacteria, even though the product had not gone through proper testing.

Because the company advertised that their nano silver filter was intended to” prevent, destroy, repel or mitigate bacteria and mold,” it was classified as a pesticide. Under EPA rules, pesticides must be registered with the Agency prior to distribution or sale. The company failed to do so.

In addition, the air purifiers did not list a valid EPA establishment number on the packaging, a federal requirement that helps regulators keep track of where pesticides and devices are produced.
